TERMS OF SERVICE – Beginner Guitar Course

OVERVIEW

This website and course are operated by Steven T Williamson. Throughout the site, the terms “we”, “us”, and “our” refer to Steven T Williamson. We provide this website, along with all information, tools, and services available from it, including the Beginner Guitar Course (“Course”), to you (“the user”), conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.

By visiting our site and/or purchasing access to the Course, you engage in our “Service” and agree to be bound by the following Terms of Service (“Terms”). These Terms apply to all users of the site, including browsers, customers, students, and contributors of content.

Please read these Terms carefully before accessing or using our website. By using any part of the site, you agree to be bound by these Terms. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or purchase the Course.

Any new features, updates, or tools added to the Course or website will also be subject to these Terms.

SECTION 1 – ONLINE COURSE TERMS

By agreeing to these Terms, you confirm that you are at least 18 years old, or you have obtained permission from a parent or legal guardian who has agreed to purchase and supervise your use of the Course.

You may not use our Course or website for any illegal or unauthorized purpose, nor may you violate any laws in your jurisdiction (including copyright laws).

Any breach of these Terms may result in immediate termination of your access to the Course and/or website.

SECTION 2 – GENERAL CONDITIONS

We reserve the right to refuse service to anyone at any time, subject to our obligations under applicable consumer and anti-discrimination laws.

You understand that your content (excluding payment information) may be transferred unencrypted across various networks. Payment information is always encrypted during transfer.

You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Course or website without our express written permission.

Section headings are for convenience and do not limit these Terms.

SECTION 3 – ACCURACY, COMPLETENESS & TIMELINESS OF INFORMATION

We do our best to provide accurate and up-to-date information, but we are not responsible if information on the site or within the Course is not complete, current, or error-free.

Any reliance on the material provided is at your own risk.

We may update or change Course content at any time, but we are not obligated to do so.

SECTION 4 – MODIFICATIONS TO SERVICE & PRICES

Prices for the Course or other products may change without notice.

We reserve the right to modify or discontinue any part of the Service at any time.

We are not liable to you or any third party for any modification, price change, suspension, or discontinuance of the Service, except as required under the Australian Consumer Law or other applicable laws.

SECTION 5 – COURSE ACCESS & CONTENT

The Course is available exclusively online through our website or learning platform.

  • When you purchase the Course, you receive lifetime access (meaning the lifetime of the Course, as long as it is offered by us).

  • Access is personal to you and may not be shared or transferred.

  • Course materials—including videos, PDFs, audio files, and downloads—are for personal, non-commercial use only.

We reserve the right to limit access to the Course or update/remove content as needed.

We do not guarantee that the quality of the Course will meet your expectations or that any errors will be corrected, and we do not guarantee any particular learning outcome or level of guitar skill.

You are responsible for ensuring you have suitable internet access, hardware, and software to access the Course.

 

SECTION 5A – INTELLECTUAL PROPERTY

All Course materials, including videos, audio recordings, text, worksheets, PDFs, tabs, backing tracks, graphics, and other content (“Course Materials”), are owned by us or our licensors and are protected by copyright and other intellectual property laws.

When you purchase the Course, we grant you a personal, limited, non-exclusive, non-transferable licence to access and use the Course Materials for your own private, non-commercial use only.

You must not, without our prior written permission:

  • copy, reproduce, record, share, publish, upload or distribute any Course Materials to any other person; or

  • sell, resell, rent, or otherwise exploit the Course Materials for commercial purposes.

 

SECTION 5B – HEALTH & SAFETY

Playing guitar can involve repetitive movements and physical strain. You are responsible for monitoring your own physical condition and safety when using the Course.

We recommend that you:

  • warm up before playing;

  • take regular breaks; and

  • stop immediately and seek appropriate professional advice if you experience pain, numbness, discomfort or other concerning symptoms.

The Course does not provide medical advice. You should consult a qualified health professional regarding any concerns about injury, physical limitations, or other health issues.

SECTION 6 – BILLING & ACCOUNT INFORMATION

We reserve the right to refuse any order or enrollment. We may cancel or limit purchases made under the same account, payment method, or email.

You agree to provide accurate, current, and complete purchase and account information and to update your information promptly (including email, billing address, and payment details).

SECTION 7 – OPTIONAL TOOLS

We may provide access to third-party tools or learning platforms over which we have no control.

You acknowledge that such tools are provided “as is” and “as available”, without warranties or conditions of any kind and without any endorsement by us.

Your use of third-party tools is entirely at your own discretion and risk, and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party providers.

You are prohibited from using the website or Course:

  • for any unlawful purpose;

  • to infringe or violate intellectual property rights;

  • to harass, abuse, insult, harm, defame, intimidate, or discriminate against others;

  • to upload or transmit viruses or any other type of malicious code;

  • to collect or track the personal information of others without their consent;

  • to interfere with or circumvent the security features of the website or learning platform;

  • to transmit false or misleading information; or

  • to send unsolicited or unauthorised advertising (spam).

We may terminate your access for violating any prohibited uses.

SECTION 13 – DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY

We do not guarantee that your use of the Service will be uninterrupted, timely, secure, or error-free.

The Course and all materials are provided “as is” and “as available”, without any warranties of any kind, either express or implied, except to the extent such warranties cannot lawfully be excluded.

To the maximum extent permitted by law, we are not liable for any:

  • indirect;

  • incidental;

  • special;

  • punitive; or

  • consequential

damages, including injury (such as hand or wrist strain), lost profits, lost data, loss of goodwill, or similar losses arising from or related to your use of the Course or website.

Nothing in these Terms excludes, restricts, or modifies any rights or remedies you may have under the Australian Consumer Law or any other law which cannot be excluded, restricted, or modified by agreement.

SECTION 13A – AUSTRALIAN CONSUMER LAW

Nothing in these Terms excludes, restricts, or modifies any consumer guarantees, rights, or remedies conferred by the Australian Consumer Law or any other applicable legislation that cannot be excluded, restricted, or modified by agreement.

Where the Australian Consumer Law applies, and where it is lawful to do so, our liability for failure to comply with a consumer guarantee is limited to, at our option:

  • supplying the services again; or

  • paying the cost of having the services supplied again.

SECTION 14 – INDEMNIFICATION

You agree to indemnify and hold harmless Steven T Williamson, and any employees, contractors, and partners, from any claims, demands, losses, damages, liabilities, costs or expenses (including reasonable legal fees) arising out of:

  • your breach of these Terms; or

  • your misuse of the Course or website.

This indemnity is subject to and does not limit any rights you may have under the Australian Consumer Law.

SECTION 15 – SEVERABILITY

If any part of these Terms is determined to be unlawful, void, or unenforceable, that portion will be deemed severed, and the remaining provisions will continue to be valid and enforceable.

SECTION 16 – TERMINATION

These Terms remain in effect unless and until terminated by either you or us.

You may terminate these Terms at any time by ceasing to use the site and Course.

If, in our sole judgment, you fail to comply with any term or provision of these Terms, or we suspect that you have failed to comply, we may terminate your access to the Course and/or website at any time without notice. You remain responsible for any payments owed up to the date of termination, subject to our Refund Policy and your rights under the Australian Consumer Law.

SECTION 17 – ENTIRE AGREEMENT

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and us regarding your use of the Course and website and supersede any prior or contemporaneous agreements, communications, and proposals, whether oral or written.

SECTION 18 – GOVERNING LAW

These Terms and any dispute or claim arising out of or in connection with them are governed by the laws in force in Queensland, Australia.

You and we submit to the non-exclusive jurisdiction of the courts of Queensland and the Commonwealth of Australia.

SECTION 19 – CHANGES TO TERMS OF SERVICE

We may update or modify these Terms at any time. When we do, we will update the “Last updated” date at the top of this page.

Your continued use of the Course or website after any changes are posted constitutes acceptance of those changes.
